I am no legal expert, the following is based upon articles I have read on the subject.

Not being a paid charter does not protect you from being sued.
You can be sued by a dive buddy who runs into trouble. There is a good case for dive buddy waivers.
You can get a waiver from people who board your boat, and it may help you win a lawsuit, but even it cannot prevent you from being sued.

Joint liability almost seems to ensure that everyone who is even remotely involved in any incident may get sued.
